When do the FCC Part 97 Amateur Radio Service rules NOT apply to the operation of an amateur station?

Why Section 97.103(a) makes the station licensee responsible for the proper operation of the station at all times, so Part 97 governs every transmission an amateur station makes. Emergency and public service work does not create an exemption: RACES operation is itself defined and regulated within Part 97 (97.407), and ARES is simply an ARRL volunteer program with no regulatory force of its own. The only narrow allowance is 97.403/97.405, which lets you use any means of radiocommunication at your disposal when immediate protection of life or property requires it and normal channels are unavailable, and even that is written into the FCC rules.
Watch out RACES is the tempting pick because it is a formal, government-sponsored civil defense service, but its rules are an additional layer inside Part 97, not a replacement for it.
No program, agency, or emergency turns Part 97 off. FCC rules always apply.

47 CFR 97.103(a) Station licensee responsibilities.

(a) The station licensee is responsible for the proper operation of the station in accordance with the FCC Rules. When the control operator is a different amateur operator than the station licensee, both persons are equally responsible for proper operation of the station.

(b) The station licensee must designate the station control operator. The FCC will presume that the station licensee is also the control operator, unless documentation to the contrary is in the station records.

(c) The station licensee must make the station and the station records available for inspection upon request by an FCC representative.
